Terms and conditions<\/h5>

The following terms and conditions apply exclusively to business transactions between Combo AG and the customer. They shall in any case take precedence over any other terms and conditions sent by the customer or contained in the customer's documents.<\/p>

Prices<\/h5>

Unless otherwise stated, all prices are expressed in Swiss francs. They are generally shown including VAT for domestic deliveries and excluding VAT for deliveries abroad. All prices are guide prices and only the most recent quotation is valid for a period of 30 days or unless otherwise stated on the quotation, unless there are typing, printing or calculation errors.<\/p>

Deliveries<\/h5>

Postage and packaging are free of charge for domestic deliveries of therapy instruments. For deliveries abroad, only the postage will be charged. No claims for damages for loss of profit, business interruption or any other financial loss can be asserted against Combo AG for late deliveries.<\/p>

Payment modalities<\/h5>

For customers from abroad, orders will only be executed if the amount due is transferred to our account in advance.<\/p>

Warranty conditions<\/h5>

Combo AG undertakes to remedy all defects that are attributable to material or manufacturing faults. The warranty covers the repair of the instrument free of charge or the replacement of defective parts free of charge. Claims for rescission, reduction in price, replacement of the instrument and reimbursement of costs in the event of damage repair by third parties without our written consent are excluded, as are claims for damages that go beyond the replacement of the defective part.<\/p>

Travel and shipping costs to the customer will be invoiced.<\/p>

The invoice or delivery bill from Combo AG, on which the date of purchase and the model must be recorded, shall serve as proof of the warranty claim.<\/p>

The guarantee does not apply to parts that are subject to natural wear and tear or to faults caused by improper operation or use, such as rental or external influences.\u00a0Furthermore, the user is obliged to subject all moving parts, screws and rivets to an adequate wear test at regular intervals of one week; failure to do so will result in the forfeiture of any claim for compensation for consequential damage<\/strong>.<\/p>

If repairs or attempted repairs are carried out by anyone other than Combo AG, the warranty claim is forfeited.<\/p>

Combo AG provides a 24-month warranty - even for commercial use (except GIGER MD\u00ae Combofit) - calculated from the date of delivery of the brand-new instrument.<\/p>

Appropriate use of the object of purchase<\/h5>

If it is not expressly stated on the delivery documents that the equipment is for \u201eprofessional users\u201c, and thus a public treatment license is coherent with the device, it is only a private license for the use of the therapy device for private use. Commercial use of the equipment is prohibited in this case, as the commercial treatment of patients always requires proper training by the manufacturer and professional equipment.<\/p>

In addition, this license strictly prohibits the licensee from making any modifications or alterations to GIGER MD\u00ae instruments without the written consent of the licensor.<\/p>

Unless otherwise agreed in writing, the license granted to the purchaser is a NON-exclusive, NON-transferable license and the licensee is not permitted to make any modifications to the GIGER MD Therapy Instrument.<\/p>

Software product, know-how<\/h5>

The software product for the GIGER MD\u00ae instruments and the know-how may only be used within the scope of the relevant license agreement.<\/p>

Disclaimer<\/h5>

Combo AG reserves the right to waive all liability in the event of non-compliance with the operating instructions and general instructions as well as improper use of the GIGER MD\u00ae instruments.<\/p>

Applicable law, place of jurisdiction and amendments<\/h5>

This agreement or declaration is subject exclusively to Swiss law. The place of collection and exclusive place of jurisdiction for all disputes arising in connection with this agreement or declaration is the registered office of Combo AG. However, this company is also authorized to assert its rights at the domicile of the customer or before any other competent authority and also to choose the applicable national law. All changes concerning these General Terms and Conditions must be made in writing.<\/p>
